Arkansas — Ashley Bancstock Co. v. Meredith, 2017 Ark. App. 598, decided 11/8/17.  The Arkansas Court of Appeals interpreted the corporation law’s inspection of books and records provision as providing (1) shareholders bear the burden of proving entitlement to an inspection, (2) specific allegations of wrongdoing are not required, (3) no limit is impose on how many year’s worth of documents may be requested, (4) shareholders may inspect a subsidiary’s documents, (5) a corporation need only provide the records it possesses, and (6) liability insurance policies are records subject to inspection.
